An Ordinance of the Village of Villa Park, DuPage County, Illinois Amending Article 4, Entitled "MX Districts", Article 6, Entitled "Uses", and Article 14 Entitled "Measurements and Definitions" of the Villa Park Zoning Ordinance



The ordinance before the board for 1st reading would a correct various scrivener’s errors, typos, and misspellings; formats tables for readability, re-labels figures, introducing titles that were omitted when codified on-line and re-ordering where needed to keep them sequential, corrects the labels in table 4.4.3 General Building, correctly labeling the districts within which the building form is permitted, modifies all permitted uses of the district will be permitted by right for MX-R1, and MX-R2, corrects MX-2 District (It is one district, not “MX-2a” and “MX-2b” as indicated in 4.1.1. - The Districts, and corrects driveway widths to match Article 7 Parking.  This Ordinance will also make the following amendments to Article 6 – Uses, specifically Table 6-1: Use Table related to the MX districts; Office and Trade Schools allowed on ground floor in MX-1 and MX-2, allows Funeral and Mortuary Service in MX-2.  This Ordinance will also make the following amendments to Article 14 - Measurements and Definitions; add a definition for Pocket Park and clarify Yard, Rear definition.

 

The Planning and Zoning Commission recommends approval of the amendments.

Ordinance of the Village of Villa Park, DuPage County, Illinois Approving a Second Amendment to the Letter of Intent for the Purchase and Development of 100 - 110 S. Villa Avenue Between Catalyst Partners and the Village of Villa Park



The Village approved a Letter of Intent for the purchase and development of 100 – 110 S. Villa Ave. December 6, 2021 with Catalyst Partners and Marquette Companies (the developers).  The developers have proposed a high density, mixed-use project.

 

As the developers were unable to find a general contractor that would commit to a fall 2022 construction start due to the inability to secure construction materials, the Village approved an amendment to the Letter of Intent July 25, 2022, extending the due diligence period to January 15, 2023.

 

As with many large-scale projects, the developers have continued to deal with the volatile nature of construction costs, supply chain issues, and potential design changes.  As a result of these factors, the developers have requested a second six-month extension.  The developers would deposit an additional $25,000 in earnest money if the extension was granted.

A Resolution of the Village of Villa Park, DuPage County, Illinois for the Utilization of Motor Fuel Tax Funds for the General Maintenance Activities for the Fiscal Year 2020 in the Amount of $841,500.



The Village annually transfers a portion of its Motor Fuel Tax (MFT) allotment from the State of Illinois to the Corporate Fund and Street Fund to defray expenses associated with street maintenance, snow removal, streetlight and traffic control electricity and maintenance. A resolution is required to authorize the transfer of MFT funds to the Corporate and Street Funds.  This resolution is retroactive as to allow the Village to utilize MFT funds for the Fiscal Year 2020.  This will allow the Village to reconcile our MFT account with Illinois Department of Transportation.

 

Staff recommends approval of this resolution.

A resolution is required to authorize the transfer of MFT funds to the Corporate and Street Funds. The budget account for the transfer to the Corporate Fund is 32.502.02.710 and the budget account for the transfer to the Street Fund is 32.502.02.725. The total amount that was transferred is $750,000.00.  This resolution is to retroactivity approve the funding that was spent to allow the Village to reconcile our MFT account with Illinois Department of Transportation.

Resolution of the Village of Villa Park, DuPage County, Illinois, Approving Final Change Order Number 4 to the Contract with A Lamp Concrete Contractors, Inc., of Schaumburg, Illinois, for Construction of the Maple Area Improvement Project for a Net Addition in the Amount of $42,668.03



The Village has a contract with A Lamp Concrete Contractors, Inc., of Schaumburg, Illinois, in the amount of $3,650,688.10 for the construction of the Maple Area Improvement Project.  Proposed final Change Order Number 4 consists of the final balancing of contract quantities as measured in the field.  The net amount of the proposed final Change Order Number 4 is an addition in the amount of $42,668.03, for an adjusted contract amount of $3,693,356.13.  Staff recommends approval of this change order. 

 

This item satisfies the Village's Short-Term Complex Strategic Plan Goal "Continue using an aggressive infrastructure replacement/development plan that covers sewer, water mains, streets, etc."

A Resolution of the Village of Villa Park, DuPage County, Illinois Proposing a Redevelopment Plan and Project For, and the Designation Of, the St. Charles Road Commercial Corridor Redevelopment Project Area and the Adoption of Tax Increment Allocation Financing Therefor, Convening a Joint Review Board and Calling a Public Hearing in Connection Therewith   



The Village engaged Teska Associates, Inc. to conduct an eligibility study and create a redevelopment plan for a proposed Tax Increment Finance (TIF) District focused on the St. Charles Road commercial corridor.  With the eligibility study and redevelopment plan now complete, the Village can begin the process of considering creating the TIF district.  This resolution would set the date for the Joint Review Board to meet February 9, 2023, and the date for the public hearing for March 13, 2023.

 

Staff Recommends approval of the ordinance.

 

This resolution advances Short Tern Complex Goal #4 Continue to update an aggressive/proactive economic development plan for each of business corridors that includes updating our business database.

Resolution of the Village of Villa Park, DuPage County, Illinois Approving the Purchase of Recreation Amenities for the Lufkin Park Renovation Project, in a Total Amount Not to Exceed $300,744 



In November, a detailed request for proposals was prepared for recreation amenities related to the Lufkin Park Renovation Project.  All the equipment/structures being recommended for approval have been previously bid through Sourcewell cooperative purchasing program.  The Parks and Recreation Commission and Village staff reviewed submitted proposals and is recommending the Village proceed with the following vendors: Burke Equipment for a total amount of $98,949 for nature playground equipment and the "ninja" fitness obstacle course, RainDrop LLC for a total amount of $48,143 for the water splash pad and RCP Shelters Inc. in a total amount of $153,652.  The total equipment purchase price is not to exceed $300,744.  Staff recommends approval of this resolution.
